Kogi Governorship Election: Court Confirms APC Candidate Ododo’s

Justice Obiora Egwuatu affirmed Ododo as the APC candidate while delivering judgment in a suit filed by Mr Abubakar Achimugu, also of the APC challenging the candidature of Ododo.
 
Achimugu anchored his suit  on the grounds that Ododo, as at the time he contested the primary election to fly the flag of APC in the Nov. 11 election in Kogi, were still public servants in the state civil service.
 
In the judgment, Justice Egwuatu held that contrary to the claim of Achimugu, evidence showed that Ododo resigned his appointment more than 30 days before participating in the APC primary.
 
The judge said that exhibits tendered by the defendants showed that while Ododo’s resignation letter was received by the Office of the Kogi governor on March 8, that of the 3rd defendant, Mr Salami Deedat, was received on March 9.
 
“I have examined the letters of resignation filed by the defendants, they were addressed to the Kogi governor and were duly received and signed.
 
“A resignation letter becomes effective once it is received and accepted by the relevant authority. It is not when the authority replies the letter that it becomes effective.”
 
The judge held that where a letter of resignation has been received and duly signed, it takes effect and the employee would not be held responsible if the employer continues with the payment of salary.
 
The court said it was convinced that the defendant resigned his appointments as Auditor-General for Local Governments and Deedat as Commissioner for Local Governments respectively before contesting the primary election.
 
“I am satisfied that they resigned their appointments from Kogi government on March 8 and 9 respectively more than 30 days before the April 14 primary election.
 
“I hold that this suit is bereft of any merit and accordingly dismissed,” the judge said.
 
Earlier, the court dismissed the preliminary objection of the defendants claiming that the suit was statute barred having not filed it within 14 days as required by law.
 
The judge agreed with the plaintiff that the cause of action actually occurred on April 14, when Ododo and Deedat contested the primary and not when they purchased the expression of interest and nomination form.
 
The News Agency of Nigeria, (NAN) reports that the Independent National Electoral Commission, (INEC) had on April 15, declared Ododo winner of APC primary election to elect a candidate for the party’s for the Nov.11 governorship election in the state.
 
Miffed by this,  Achimugu approached the court asking that the primary election be nullified and Ododo be disqualified from contesting the governorship election on grounds that he was still an employee of the Kogi government when he contested.
 
The plaintiff in the suit marked: FHC/ABJ/CS/584/2023, claimed that Ododo breached Section 182 of the Constitution, Section 84 of the Electoral Act, 2022, and Article 7 of the APC’s Constitution in participating in the April 14 governorship primary of the APC.
 
Achimugu argued that Ododo’s failure to resign his appointment with the Kogi government, 30 days to the primary, made him ineligible for the Nov. 11guber poll.
 
Listed in the suit as defendants were the APC, Ododo,  Deedat and INEC as 1st, 2nd, 3rd and 4th defendants.
 
Amongst the issues brought before the court for determination was  whether Ododo was eligible to participate in the governorship election slated for Nov. 11.
 
This was in view of the fact that both at the time of submitting their nomination and expression of interest forms, were still  civil/ public servants and employees of Kogi government.
 
This they said was contrary to the provisions of Section 182 (2), Section 84 (10) and (11) of the Electoral Act, 2022 Guidelines for the nomination of candidates.
 
The plaintiff said that if the answer was in the affirmative,  the court should amongst others declare that Ododo and Deedat were not qualified or eligible to have participated in the primary election.
 
This was on the grounds of being persons both employed in public service of Kogi, having failed and neglected to resign, withdraw or retire from employment at least 30 days to the April 14 when the primary election was conducted.
 
“An order of perpetual injunction restraining Ododo from parading himself as gubernatorial candidate of the APC.
 
“An order restraining APC and INEC from dealing with Ododo as the governorship candidate of the APC.
 
 “In the event Ododo was declared winner of the Nov.11 gubernatorial election before the case was fully determined, the certificate of return issued to him by INEC should be withdrawn.”
 
 Mr Josiah Daniel-Ebune, counsel to Achimugu, told newsmen after the court proceedings that he would brief his client on the judgment to know the next line of action.

The Peoples Redemption Party, PRP Presidential Primary is marred by irregularities as insiders and stakeholders said the Party is abandoning its own founding principle, engineering election process to suit particular candidate.

According to a well-informed party insider the outcome of the Presidential primary election does not reflect the actual account of what happened, saying that the outcome was engineered and the inflation was not unintentional disorder but a deliberate plan orchestrated to deliver the nomination to a preferred candidate in service of a prearranged ticket.

Those same insiders point to reported plans for Mr. Duke to run alongside Senator Datti Baba-Ahmed, younger brother of the National Chairman, Dr. Hakeem Baba-Ahmed.

“We do not state these motives as proven fact. We state them as serious allegations raised by people positioned to know, allegations that the party’s leadership now has an obligation to answer rather than ignore.” The statement added,

The People Redemption Party conducted its presidential primary on May 25th, 2026 under guidelines it issued just one day before the election. The explicit guidelines said only members whose names appeared on the official membership register submitted to the Independent National Electoral Commission as of 4 May 2026 were eligible to vote. That register was the governing document. It was the single source of truth agreed by all parties before a single ballot was cast.

Result declared as against that register, defies the fundamental tenet of mathematics.

For example, in Gombe State, a register of 348 members produced 1,431 votes, a 311 percent difference, with more than 1,000 ballots. In Bauchi State, a register of 593 members produced 760 votes, 167 more ballots than there were people permitted to cast vote. In Kwara State, 55 registered members somehow produced 82 votes, an excess of nearly 50 percent. These are only a few examples from the results released.

According to eye-witness, collation at the party’s National Headquarters was itself halted amid widespread irregularities, raising even deeper concerns about the integrity of the overall process.

Across these states, 996 registered members produced 2,273 votes. That is 1,277 ballots that correspond to no eligible voter on the party’s own INEC-approved list. More than half of the total declared vote did not lawfully exist.

According to the statement released by one of the Aspirant, Dr. Ufere, “The phantom votes were not random. They broke overwhelmingly, in state after state, in favour of a single aspirant, Mr. Donald Duke, a man who joined the People Redemption Party only in the days immediately before the primary, having defected from another platform on the eve of the exercise. The pattern is consistent and lopsided enough to demand an explanation the party has so far refused to give.

“The questions deepen when one considers the candidate himself. Mr. Duke did not campaign for a single day of this contest. By available accounts, he was outside the country while the election was being conducted. He joined the People Redemption Party in secrecy after the relevant deadlines had already been breached. He openly offered to refund rival aspirants the costs they had incurred if they would step aside and allow him to emerge as a consensus candidate.

Also, according to a statement by the Yakubu Muhammed Kingsley YMK Nigeria Presidential Campaign Team, signed by the Director, Media and Communication, Prince Abdulrahman Obaje; “if internal democracy can be sacrificed so easily within PRP, then what moral right does the party have to promise Nigerian’s change, justice, fairness, and good governance?

The statement further revealed that the reason why they joined PRP is because of the believed that the party has over-grown money politics, political manipulation, imposition, electoral irregularities, and elite control of democratic processes.

“We believed that PRP was founded on the ideology of Justice, Equality, Accountability, Transparency, People-driven politics, And protection of the ordinary masses.

But today, many of our loyal members are asking painful questions: that

  • HAS THE PARTY ABANDONED ITS ORIGINAL IDEOLOGY?
  • HAS THE VOICE OF THE ORDINARY MEMBERS BEEN REPLACED BY THE POWER OF MONEY AND ARRANGEMENT?
  • HAS PRINCIPLE BEEN SACRIFICED FOR POLITICAL CONVENIENCE?

If genuine concerns raised across the states regarding irregularities, transparency, and credibility are ignored, then confidence in the internal democratic process of the party may continue to weaken.

The Chairman, Media and Communication of the Presidential Campaign Team Alhaji Suleman Yunusa further said, “A political party cannot successfully fight national injustice while ignoring concerns about fairness within its own structure.

“This moment requires courage, transparency, accountability, and sincere leadership.

The statement charges the leadership of the party to immediately retrack its steps to protect its dignity and integrity.

The statement further said, “The current leadership of PRP still has an opportunity to prove that:

  • The party belongs to the people,
  • Rules still matter,
  • Internal democracy still matters,
  • and justice still matters.

“History will remember whether the party defended its founding principles — or abandoned them when it mattered most, because Justice strengthens institutions, Transparency builds trust and Internal democracy protects party credibility.”, the statement concluded.

YMK Nigeria grabs a presidential nomination form, Thursday April 30th, 2026 on the platform of the Peoples Redemption Party (PRP) in a ground-breaking event saying the gesture shows the seriousness of putting Nigeria future on great pedestal.

Dr. Aliyu Abdullahi Jibia, The Director General, Campaign Organisation, YMK Nigeria Movement while speaking with journalists at the event said picking the nomination form today shows the seriousness of the candidate as a man with the integrity and quality in fixing Nigeria.

Jibia said, “We have shown the world today that we are Peoples Redemption Party and we are going to contest on the platform of the party.

Jibia further said, “Engineer Kignsly is a clean slate, the first person to contest with overwhelming support from the different parts of the six geo-political zones of Nigeria, including Abuja.

YMK at the event further assures women of greater support and empowerment in his administration, saying that he will run an all-inclusive administration after assuming office.

The National Women Leader, Peoples Redemption Party, Dr. Maryam Ringim at the event while charging all the women to go all out for membership drive, had call on every women to turn out enmass supporting the party candidate in the forthcoming election.

Ringim said, “Women are the greatest mobilisers, having the power of convincing someone immediately, easily.

“So, I want to encourage you, to encourage your people to troop in mass for the membership registration exercise, it is very important for the success of the candidate.

“So, I am thanking you all for all your efforts for remaining loyal as I know that you are doing very well.”, she concluded.

As at April 30th, 2026, Engr Dr. Yakubu Muhammad Kingsly (YMK) Nigeria, the presidential candidate of PRP is officially the first presidential candidate to pick a Presidential Nomination form from any party political party in Nigeria against the 2027 Presidential Election.
